Tribunal desestima derecho de autoría

En un caso estrechamente seguido en el mundo del arte, el artista estadounidense Richard Prince ganó una orden de la corte de Apelaciones federal al sostener que no infrinje los derechos de autoría de un fotógrafo por incorporar a sus imágenes de 25 pinturas y collages.

El 2 º Tribunal del circuito de Apelaciones en Nueva York invirtió la decisión de una corte especial menor que ordenó a Prince entregar la ilustración de las fotos a Patrick Cariou, cuyas fotos de Rastafaris en Jamaica se incorporaron al arte, exhibido en 2007 y 2008.

"Estas veinticinco obras de arte de Prince manifiestan una estética totalmente diferente de las fotografías de Cariou", escribió el juez del circuito Barrington Parker.

La batalla judicial se ha considerado como una prueba de hasta qué punto la apropiación de obras de artistas está protegida de reclamaciones de infracción de derecho de autoría.

El caso judicial atrajo a simpatizantes como "amigos de la corte" a una amplia gama de partes, desde el Whitney Museum of American Art hasta Google Inc, advirtiendo el que fallo del tribunal inferior como desviación de análisis estándar de derechos de autor de manera "peligrosa".

La sentencia es "una gran victoria para un género entero del arte moderno y Richard Prince", dijo Anthony Falzone, abogado de la Andy Warhol Foundation para Visual Arts, que presentó un breve apoyo a Prince.

Family Travel and Vacation for 2017

Whether you have one member of your immediate- extended family or 20 members, counting great grand children, grandchildren, children, and spouse, it does not matter the size, go on vacation in 2017 somewhere together!  The vacation will allow everyone the opportunity to focus on each other - good or bad.  Don't dwell on the bad, just know that everyone has some issues, including yourself.  Don't be surprise if you find out that you are the source of origin for many of the family arguments or disputes. 
 
The vacation, if inclusive of other's input ought to help each other to see and appreciate one another better.  Don't wait until death knocks on your family's door before you realize that you really have not spent much quality time together away from other people that you know including school, work, community involvement, religious affiliations, and other friends and relations. 
 
According to Reuters, a 2008 Annual Expedia Survey Reveals Nearly One of Every Three American Workers Are Vacation Deprived.  Despite leaving three vacation days unused, 92 percent of employed U.S. adults believe they are entitled to take all the vacation days they earn, and 67 percent believe their employer encourages them to use all of their allotted vacation time. 
 
Despite reporting an average of 14 paid vacation days again this year, the same as 2007 and two more than in 2005, an estimated 47.5MM Americans(2) (31 percent of employed U.S. adults) - almost as much as the entire population of California and Illinois, combined - will not use all of their vacation days. Old study?  No, the percentage number remain the same for 2012, according to AAA.

There are literally thousands of vacation packages and experiences which are available.  On cable tv, you can go to the Travel Channel, in your towns, there are travel agencies with trained agents who will do almost all of the planning and negotiating on your behalf.  In fact, some travel agents value their customer's experience so well, that they book a trip along with their clients to assure a successful experience.  In the local Yellow Pages, you can find in the travel section, AAA who is willing to make your experience an enjoyable one.  AAA, not only list various itinerary options, for a nominal annual fee; you can create custom packages that include maps, insurance, tickets, and events.  You can go to the nearest public library to look up various places and sites to discover. 

Did you know that that your spiritual leader is also a great resource for vacation ideas - sacred and secular?  By the way, let me not forget the World Wide Web, the Internet!  The Internet is filled with opportunities and opportunities for you to explore a wide array of vacation ideas that will meet the needs of a diverse group's perspective.  Some of the sites include:  AAA, Expedia, Hotwire, Priceline, Travelocity, Booking Buddy, Holiday Inn, Hilton, Marriott, Hertz, Avis, Budget Rent A Car, Motel Six, Enterprise Rent A Car, all major resort listings, hotels and motel chains, rental car chains, and so forth.  If you are still unsure, you can pull up a search engine and ask questions.  Some of the search engines include:  Ask, Bing, Yahoo, Google, and MSN just to name a few. 

CAUTION:  The Internet has a vast array of options and some unsavory and dishonest sites as well.  Be extremely careful when while working with a company that will ask for a money transaction.  Make sure that the company has a reputation for doing good business.  I know a family that rented a RV from a computer online, just to find out that three out of three RVs had problems once they arrived to go on the trip:  one of the RVs transmission's failed on a long road in South Dakota, the replacement vehicle fuel pump started to leak after five miles, and the replacement, replacement had engine problems within the first mile.  The family had to end up getting a SUV to finish the vacation. 

Further, a word of caution, if your family relationship is not the best, I suggest that you make the planning of the vacation a project itself.  By including everyone in on the plans will more than likely assure an inclusive stakeholder position by everyone!  Try to involve everyone in the discussion!  Please take into account everyone's feelings!  Because, when everyone become excited about going, then everyone would assure success for as much as they are concerned.


If you don't want to go through the hassle above and want to be primed, let me suggest the following:  go south! Go all the way south! Go to the southernmost point of the Continental United States, Key West, Florida!  In fact, at Key West, Florida, you will find a historical marker pointing to the National Monument entitled, the Southernmost Point in the United States - 90 miles from Cuba. The Southernmost Point buoy is an anchored concrete buoy in Key West, Florida marking one of the extreme points of the United States. The large painted buoy is a tourist attraction established in 1983 by the city at the corner of South Street and Whitehead Street.

The Southernmost point was originally just marked with a sign, which was often stolen. In response to this, the city of Key West erected the now famous concrete buoy in 1983.  The concrete buoy is actually an old sewer junction that was dug up in the area and found too heavy and large to move, so it was painted up to look like a buoy.
Today it is one of the most visited and photographed attractions in Key West. During the day there are usually several street vendors present selling various souvenirs and conch shells.  

Please note however that according to Wikimedia, The wording is not accurate. Florida's official southernmost point is Ballast Key, a privately owned island south and west of Key West. Signs on that island strictly prohibit unauthorized visitors. The marker is not even the southernmost point of Key West Island. The private yard directly to the southeast of the buoy is obviously farther south. Land on the Truman Annex property just west-southwest of the buoy is the true southernmost point on the island, (approximately 900 feet (270 m) farther south), but it has no marker since it is U.S. Navy property and cannot be entered by civilian tourists.

The southernmost part of Key West Island accessible to civilians is the beach area of Fort Zachary Taylor Historic State Park at approximately 24.545142 N, 81.80964 W, and approximately 500 feet (150 m) farther south than the marker.

The claim on the buoy stating "90 miles to Cuba" is a rounded number, since Cuba, at its closest point is 94 statute (81 nautical) miles due south.

At Key West, Florida, you will find the one of the best fishing marinas, hotels and resorts reasonably priced, several tour companies who will introduce you to Key West, great places to shop, great beaches to have fun and ski, a wide variety of rental transportation resources - bicycles, scooters, electric cars, trolleys, jet skis, boats, many historical sites, including the retired US Costal Guard Cutter Ingram Ship that served in WWII, Korean War, Vietnam, Panama Canal and protected and rescued countless stranded individuals at sea.  Further, when you visit the Southernmost Point in the United States of the America, historical marker, stop by and shop at the Southernmost Gift Shop, 1400 Duval Street, and let Jay Maro and his staff help you to find gift items for yourselves and other friends and family you left behind while you slip away to spend vacation with your family. 

If you get hungry, stop by Schooner Wharf Bar 202 Williams Street, for some finger-licking good seafood and fish, while being entertained by a live band singing hit tunes from Garth Brooks, the Righteous Brothers, Michael Jackson, and others.   How can we get to Key West, Florida?  There are several ways:  you can have a bus company or someone to take you, you can drive down, you can fly there, and even The Carnival Victory Cruise Line will dock there for you.
